The federal Pay Equity Act and pay transparency laws in Canada
The landscape of pay equity and pay transparency in Canada has evolved significantly in recent years. In 2021, the nation’s new Pay Equity Act came into force; this legislation frames a proactive approach to ensuring fair pay. Meanwhile, some provinces have adopted their own regulations. These province-level laws address pay equity, pay transparency, or both, and some extend the scope of the Federal Pay Equity Act.

About the Pay Equity Act in Canada
As of September 2024, public-sector organizations and those in federally regulated industries will need to comply with some new requirements of the Pay Equity Act. This includes forming a pay equity committee, developing a pay equity plan, and identifying any gender-based pay gaps. The first annual reports will be due in June 2025.
Provincial legislation on pay equity and pay transparency in Canada
Some organizations in both the public and private sectors also need to meet provincial requirements. For example, British Columbia, Quebec, Ontario, Prince Edward Island, Manitoba, and Nova Scotia all have pay transparency and/or pay equity legislation. Pay equity legislation might include, for instance, annual pay gap reporting, and pay transparency measures may mandate salary ranges in job postings.
